Understanding NFA Firearms
NFA (National Firearms Act) items include:

  • Machine guns
  • Silencers (suppressors)
  • Short-barrel shotguns
  • Short-barrel rifles
  • Any Other Weapons (AOWs)
  • Destructive devices

The Transfer Process

  1. NFA Weapon Registration
    • All NFA firearms are registered to an individual, corporation, or trust.
    • Ownership is like a “title” to the weapon.
    • Physical possession cannot change hands until the ATF approves the transfer.
  2. Class 3 Dealer Requirement
    • Transfers must occur through a Class 3 dealer within the buyer’s state.
    • After payment, we initiate the process by filing an ATF Form 3 for the transfer.
  3. ATF Form 3 Submission
    • We submit Form 3 to the NFA branch of the ATF via fax.
    • Approval typically takes 30–45 days. Once approved, we receive the physical documentation by mail and then ship the NFA item to your local dealer.

Receiving and Inspecting Your NFA Item

When your NFA item arrives at your dealer:

  • Inspect the item thoroughly.
  • Report any issues immediately during the 3-day inspection period.
  • If necessary, we’ll refund or repair the item.

Final Transfer to You

  1. ATF Form 4 Submission
    • Your local dealer will assist in completing ATF Form 4, which includes:
      • Firearm details (serial number, etc.)
      • Dealer’s FFL information
      • Transferee’s name (individual or trust)
    • Attach a passport-sized photo and your fingerprints.
    • CLEO sign-off is no longer required, removing previous local law enforcement roadblocks.
  2. Form Submission and Tax Payment
    • Submit two copies of the completed Form 4 to the ATF with a $200 tax payment.
  3. Approval Process
    • The ATF will perform a background check and verify your documentation.
    • Approval takes approximately 4–6 months, depending on workload.

Possession of Your NFA Item

When approval is granted:

  • The ATF sends the completed transfer documentation to your dealer.
  • You can now legally take possession of your NFA firearm.
